Terms of Service.

1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your use of the AgentPlanyx website and SMS Help Desk (together, the “Service”). AgentPlanyx is a new, independently operated project based in Japan.

By accessing or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. The Service

AgentPlanyx provides an automated, SMS-based information help desk. Users can ask general questions about everyday technology, software, and productivity and receive concise informational responses.

The Service is not a human-staffed customer support line, a professional advisory service, or an emergency service. Features and scope may change as this new project develops.

3. Eligibility

You must be able to enter a binding agreement under the law that applies to you. If you are under the age of legal majority where you live, use the Service only with permission and supervision from a parent or legal guardian. The Service is not directed to children under 13.

You are responsible for the mobile device, telephone number, account, and carrier plan used to access the Service.

4. SMS program terms

Opt-in

Text START to +1 833-762-4508 to receive recurring automated answers and support messages from AgentPlanyx in response to questions you initiate. Consent is not a condition of purchasing any good or service.

Frequency and charges

Message frequency varies based on your activity. Message and data rates may apply under your mobile plan. AgentPlanyx does not charge a separate fee for sending or receiving SMS messages, but your carrier may.

Help and opt-out

Reply HELP for help or email martin@agentplanyx.com. Reply STOP to opt out. After you text STOP, you may receive a final confirmation and no further program messages unless you opt in again by texting START.

Delivery

Wireless carriers are not responsible for delayed or undelivered messages. SMS availability depends on carrier support, network availability, device compatibility, and other conditions outside AgentPlanyx’s control. Not all carriers or locations may be supported.

5. Acceptable use

You agree not to use the Service to:

• violate law or another person’s rights;
• send unlawful, threatening, abusive, harassing, deceptive, or exploitative content;
• request or facilitate malware, unauthorized access, fraud, or other harmful activity;
• interfere with, overload, probe, scrape, reverse engineer, or bypass safeguards of the Service; or
• submit sensitive personal information that is unnecessary for your question.

AgentPlanyx may decline to answer a request or restrict access when reasonably necessary to protect users, providers, or the Service.

6. Automated answers and important limits

Responses are generated automatically and may be incomplete, outdated, or incorrect. You are responsible for evaluating answers and confirming important information with authoritative sources before acting on it.

AgentPlanyx does not provide financial, medical, legal, emergency, or safety-critical advice. Do not rely on the Service for decisions where an error could cause injury, loss, rights violations, or significant harm. Contact a qualified professional or the appropriate local emergency service when needed.

7. Privacy

The Privacy Policy explains how AgentPlanyx handles mobile numbers, messages, opt-in records, support emails, and technical information. By using the Service, you acknowledge those practices.

8. Availability and changes

The Service is provided without a guarantee of continuous availability, response time, delivery, or compatibility. AgentPlanyx may maintain, change, suspend, or discontinue some or all of the Service when reasonably necessary, subject to applicable law.

Content, visual design, and service capabilities may evolve. Material changes to the SMS program’s purpose or consent flow will be reflected in the public program disclosure.

9. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. AgentPlanyx disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law, AgentPlanyx will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunities, goodwill, or business, arising from or related to the Service.

These limitations do not apply where liability cannot be limited or excluded under applicable law. Your carrier’s charges remain your responsibility.

11. Termination

You may stop using the Service at any time and can leave the SMS program by texting STOP. AgentPlanyx may suspend or end access for misuse, legal or security reasons, provider requirements, or discontinuation of the Service.

Terms that by their nature should survive termination—including limitations, disclaimers, and governing-law provisions—will continue to apply.

12. Governing law

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles, except where mandatory consumer-protection law requires otherwise. Before starting formal proceedings, you and AgentPlanyx agree to make a reasonable effort to resolve a dispute through the support email below.

13. Changes to these Terms

These Terms may be updated to reflect changes in the Service, providers, or legal requirements. The revised Terms will be posted here with a new effective date. Your continued use after the effective date constitutes acceptance where permitted by law.
